SETTLEMEMENT OF DISPUTE WITH LUMASENS

Quebec City, CANADA (December 4, 2009) – On December 1, 2009, LumaSense Technologies and Neoptix resolved a lawsuit that had been filed by LumaSense Technologies against Neoptix in the United States District Court for the Northern District of California against Neoptix, styled Lumasense Technologies v Neoptix, Case No. C-09-02023-WHA (the “Lawsuit”). The lawsuit arose from Neoptix’ registering two internet domain names that were misspellings of the name “LumaSense.” Neoptix regrets its conduct in registering the two domain names, and is pleased to announce that the parties have settled the Lawsuit pursuant to a confidential settlement agreement.
